Privacy Policy

Yorkshire Planning Incorporated d/b/a Yorkshire College Planning (“us,” “we,” or “our”) operates the https://yorkshirecollegeplanning.com website, the Member’s Portal, and the related online tools and applications through which we deliver our College Aid Executive, College Aid Accelerator, and College Funding Pro programs (collectively, the “Service”). This Privacy Policy describes how we collect, use, disclose, and protect information when you use the Service, and the choices you have associated with that data.

We use your data to provide and improve the Service. By using the Service, you agree to the collection and use of information in accordance with this Privacy Policy. If you do not agree with this Privacy Policy, please do not use the Service.

  1. 1. Scope of This Policy.

    This Privacy Policy applies to information we collect through the Service, including our public website, our free webinars and workshops, the Practice FAFSA and Practice CSS tools, the Member’s Portal, and our email, text, telephone, and video communications with you. It does not apply to the practices of third parties that we do not own or control, including the U.S. Department of Education, the College Board, colleges and universities, scholarship providers, and any third-party website or service you access through a link on the Service. Our collection and use of information in connection with a paid program is also subject to the Standard Terms and Conditions applicable to that program, and your use of the Service is subject to our Website Terms and Conditions of Use and our End User License Agreement. As used in this Privacy Policy, “Household” has the meaning given to that term in the End User License Agreement.

  2. 2. Information We Collect at a Glance.

  3. 3. Personal Data.

    While using our Service, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you (“Personal Data”). Personal Data may include, but is not limited to:

    1. email address;
    2. first name and last name;
    3. telephone number;
    4. address, city, state or province, and ZIP or postal code;
    5. information about the student or students in your Household that you choose to provide;
    6. financial and college aid information that you choose to provide in connection with a program, the Practice FAFSA tool, or the Practice CSS tool; and
    7. cookies and Usage Data.

    You are not required to provide any particular item of Personal Data, but declining to provide information necessary to deliver a program may limit our ability to perform the services you purchased or wish to obtain.

  4. 4. Usage Data.

    We may also collect information about how the Service is accessed and used (“Usage Data”). Usage Data may include information such as your computer’s Internet Protocol address (e.g., IP address), browser type, browser version, the pages of our Service that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers, and other diagnostic data.

  5. 5. College Aid and Financial Information.

    Delivering our programs may involve information about your household finances, including information of the type reported on the FAFSA and the CSS Profile. We collect this information only where you choose to provide it, we use it only to provide and support the services you purchased and to document any program guarantee, and we do not use it for advertising or sell it. We do not file, transmit, or submit the FAFSA, the CSS Profile, or any other application on your behalf, and the Practice FAFSA and Practice CSS tools are educational simulations only. We ask that you not send us Social Security numbers, taxpayer identification numbers, financial account numbers, or FSA ID credentials, and we do not require them to deliver our programs. If you send such information to us, we will handle it in accordance with this Privacy Policy and will delete it when it is no longer needed for the purpose for which it was provided.

  6. 6. Information About Students.

    Our programs are purchased by parents and guardians for the benefit of a student. Where you provide information about a student, including a student under the age of eighteen (18), you do so in your capacity as the account holder, and you represent that you have the authority to provide that information. We use student information only to deliver the program to you, we do not use it to market to the student, and we do not sell it. We are not a school, school official, or educational agency, and we do not receive education records directly from an institution under the Family Educational Rights and Privacy Act; if you choose to share a document that originated with a school, we treat it as information you provided to us.

  7. 7. Tracking and Cookies Data.

    We use cookies and similar tracking technologies to track the activity on our Service and hold certain information. These technologies may be used for analytics and to help us understand how users interact with the Service; depending on how they are configured, they may also be used for advertising-related measurement or cross-context behavioral advertising.

    Cookies are files with a small amount of data which may include an anonymous unique identifier. Cookies are sent to your browser from a website and stored on your device. Tracking technologies we also use include beacons, tags, and scripts to collect and track information and to improve and analyze our Service.

    You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent. However, if you do not accept cookies, you may not be able to use some portions of our Service. Examples of cookies we use:

    1. Session Cookies. We use Session Cookies to operate our Service.
    2. Preference Cookies. We use Preference Cookies to remember your preferences and various settings.
    3. Security Cookies. We use Security Cookies for security purposes.
    4. Analytics and Advertising Cookies. We use these cookies to understand how the Service is used and, where configured, to measure the performance of our advertising.

    We honor legally recognized opt-out preference signals, such as the Global Privacy Control, in a frictionless manner where applicable law requires.

  8. 8. Use of Data.

    We use the collected data for various purposes:

    1. to provide and maintain the Service;
    2. to create, administer, and secure your account and the Member’s Portal;
    3. to deliver the program you purchased, including preparing Success Maps, college cost reports, scholarship lists, and curated school research, and providing FAFSA, CSS Profile, and appeal support;
    4. to notify you about changes to our Service;
    5. to allow you to participate in interactive features of our Service when you choose to do so;
    6. to provide customer care and support;
    7. to provide analysis or valuable information so that we can improve the Service;
    8. to monitor the usage of the Service;
    9. to detect, prevent, and address technical issues, fraud, and misuse;
    10. to process transactions, administer refunds, and maintain business and accounting records;
    11. to send you service, scheduling, and program communications, and, where you have consented, marketing communications; and
    12. to comply with our legal obligations, resolve disputes, and enforce our agreements.

    We may also use information provided by you or generated in connection with the Service in de-identified or aggregated form for service improvement, product development, quality assurance, benchmarking, analytics, and reporting, provided that such information does not identify you or any individual and is not reasonably capable of being re-identified. We publicly commit to maintain and use such de-identified information only in a de-identified form and will not attempt to reidentify it, except as required or permitted by law.

  9. 9. Use of Artificial Intelligence.

    Yorkshire may use artificial intelligence tools internally, in the same manner many service businesses do, to assist with tasks such as drafting, summarization, formatting, or administrative support. Where such a tool processes Personal Data on our behalf, we require any third-party provider of that tool to process the information only as necessary to provide the tool to us and not to use it to train the provider’s general-purpose models, and the resulting output remains subject to this Privacy Policy and to our own review.

    You may also choose to use a third-party artificial intelligence tool of your own, whether to prepare material you submit to us or to summarize or interpret content or guidance we provide. Any information you enter into a third-party artificial intelligence tool that we do not provide is subject to that tool’s own privacy practices, not this Privacy Policy, and may be stored, used, or disclosed by that tool’s provider in ways outside our control. Please do not enter Social Security numbers, taxpayer identification numbers, financial account numbers, government issued identification numbers, login credentials, health information, or other sensitive personal or financial information into any artificial intelligence tool that we do not provide.

  10. 10. Sharing, Sale, and Disclosure of Personal Information.

    We do not sell personal information. We have not sold personal information in the preceding twelve (12) months and do not sell personal information about visitors, clients, or the students or family members of clients, for monetary or other valuable consideration. We may disclose personal information to service providers and contractors that help us operate, maintain, and improve the Service (for example, hosting, analytics, communications, scheduling, video conferencing, payment processing, and customer support), each of which is contractually restricted to using the information only to perform services for us. Depending on how cookies and similar technologies are configured, we may “share” personal information for cross-context behavioral advertising as that term is defined under California law; you may opt out at any time as described in Section 19 and in the state privacy notice in Section 20. We may also disclose personal information in connection with a merger, acquisition, financing, reorganization, or sale of all or substantially all of our assets, subject to the recipient’s agreement to honor this Privacy Policy.

  11. 11. Legal Requirements.

    We may disclose your Personal Data in the good faith belief that such action is necessary:

    1. to comply with a legal obligation;
    2. to protect and defend our rights or property;
    3. to prevent or investigate possible wrongdoing in connection with the Service;
    4. to protect the personal safety of users of the Service or the public; and
    5. to protect against legal liability.

  12. 12. Service Providers.

    We may employ third party companies and individuals to facilitate our Service (“Service Providers”), to provide the Service on our behalf, to perform Service-related services, or to assist us in analyzing how our Service is used. These third parties have access to your Personal Data only to perform these tasks on our behalf and are contractually obligated not to disclose or use it for any other purpose, except as required by law. We require our Service Providers to maintain reasonable security measures to protect your Personal Data.

  13. 13. Analytics.

    We may use third-party Service Providers to monitor and analyze the use of our Service.

    1. Google Analytics. Google Analytics is a web analytics service offered by Google that tracks and reports website traffic. Google uses the data collected to track and monitor the use of our Service. This data may be shared with other Google services. Google may use the collected data to contextualize and personalize the ads of its own advertising network. Under certain configurations, use of analytics and advertising cookies may constitute “sharing” of personal information for cross-context behavioral advertising. California residents have the right to opt out of such sharing by emailing us at office@yorkcp.com or contacting us at one of the methods listed below. You can opt out of having your activity on the Service made available to Google Analytics by installing the Google Analytics opt-out browser add-on, which prevents the Google Analytics JavaScript from sharing information with Google Analytics about visit activity.   14. 14. Security of Data.

    The security of your data is important to us. We implement reasonable administrative, technical, and organizational security measures designed to protect your Personal Data from unauthorized access, use, alteration, or destruction, including access controls, authentication requirements for the Member’s Portal, and encryption of data in transit. However, no method of transmission over the Internet or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your Personal Data, we cannot guarantee its absolute security. If we become aware of a breach of security involving your Personal Data, we will notify you and the appropriate authorities as and where required by applicable law.

  15. 15. Retention of Data.

    Consistent with the CCPA, we do not retain personal information for longer than is reasonably necessary for the disclosed purpose for which it was collected. We will retain Personal Data only for as long as is reasonably necessary for the purposes set out in this Privacy Policy, including to comply with our legal obligations, resolve disputes, and enforce our agreements. We will also retain Usage Data for internal analysis purposes, except when it is used to strengthen security or to improve the functionality of our Service, or when we are legally obligated to retain this data for longer periods. Specific retention periods vary by data type and purpose, but generally we retain:

    1. account and contact information for the duration of your relationship with us plus four (4) years;
    2. transactional data for four (4) years; and
    3. marketing data until you opt out or for four (4) years, whichever comes first.

    Documents and financial information you upload in connection with a program are retained for the duration of your program term plus four (4) years, reflecting the time we may reasonably need to document any program guarantee, resolve a billing or service dispute, and satisfy our recordkeeping obligations. If you submit a verifiable request to delete this information before that period ends, we will honor the request unless we are permitted or required to retain the information under the CCPA or other applicable law, including because the information is reasonably necessary to complete the transaction for which it was collected, to comply with a legal obligation, or for another purpose the law permits, as described in Section 20. As described in the End User License Agreement, following termination you may also export your documents and information through the Member’s Portal for thirty (30) days, after which we may remove them from the Member’s Portal for that purpose; this self-service export is offered as a convenience, does not limit your right to request a portable copy of your personal information at any time as described in Section 20, and removing information from the Member’s Portal does not by itself shorten the retention period described in this Section.

  16. 16. Transfer of Data.

    Your information, including Personal Data, may be transferred to and maintained on computers located outside of your state, province, country, or other governmental jurisdiction where the data protection laws may differ from those in your jurisdiction. If you are located outside the United States and choose to provide information to us, please note that we transfer the data, including Personal Data, to the United States and process it there. By using the Service and submitting such information, you acknowledge and agree to the transfer of your information as described in this Privacy Policy. We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy, and no transfer of your Personal Data will take place to an organization or a country unless there are adequate controls in place, including the security of your data and other personal information.

  17. 17. Links to Other Sites.

    Our Service may contain links to other sites that are not operated by us. If you click on a third party link, you will be directed to that third party’s site. We strongly advise you to review the Privacy Policy of every site you visit. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third party sites or services.

  18. 18. Children’s Privacy.

    Our Service is not directed to anyone under the age of eighteen (18) (“Children”). We do not knowingly collect personally identifiable information directly from anyone under the age of eighteen (18), and we do not permit Children to create accounts. If you are a parent or guardian and you are aware that your child has provided us with Personal Data directly, please contact us. If we become aware that we have collected Personal Data from a child without verification of parental consent, we will take steps to remove that information from our servers as soon as reasonably practicable. Information about a student that a parent or guardian provides through the parent’s or guardian’s own account is governed by Section 6. Where a parent or guardian permits a student who is an Authorized User to access the Service directly under the parent’s or guardian’s account, consistent with the Household and Authorized User provisions of the End User License Agreement, the parent or guardian remains the account holder and is responsible for that access, and information the student submits through that access is provided with the parent’s or guardian’s authorization. California residents under the age of sixteen (16) are also subject to the opt-in protections described in Section 20 with respect to the sale or sharing of personal information.

  19. 19. Your Choices.

    You may exercise the following choices at any time:

    1. Email. You may unsubscribe from marketing emails using the link in any such email or by contacting us. We will continue to send you service and program communications necessary to deliver the services you purchased.
    2. Text messages. You may reply STOP to any text message to opt out, or HELP for assistance. Opting out of marketing texts does not opt you out of transactional or program messages.
    3. Cookies. You may configure your browser to refuse or delete cookies, and you may use a legally recognized opt-out preference signal such as the Global Privacy Control.
    4. Account information. You may review and update your account information through the Member’s Portal or by contacting us.
    5. Privacy rights requests. You may submit a request to know, delete, correct, or opt out as described in Section 20.

  20. 20. California Privacy Rights, Extended to All Users.

    This Privacy Policy is written to comply with the California Consumer Privacy Act, as amended by the California Privacy Rights Act (collectively, the “CCPA”), which we treat as the standard we hold ourselves to regardless of where you live. As a matter of our own policy, we extend the rights described in this Section to every user of the Service, not only to California residents or to residents of a state that has its own comprehensive privacy law. A number of other states have enacted similar laws, including, among others, Virginia (CDPA), Colorado (CPA), Connecticut (CTDPA), Utah (UCPA), Indiana (CDPA), Kentucky (CDPA), Montana (Consumer Data Privacy Act), Oregon (Consumer Privacy Act), Texas (Data Privacy and Security Act), Delaware (Personal Data Privacy Act), Iowa (Consumer Data Protection Act), Maryland (Online Data Privacy Act), Minnesota (Consumer Data Privacy Act), Nebraska (Data Privacy Act), New Hampshire (Expectation of Privacy Act), New Jersey (Data Privacy Act), Rhode Island (Data Transparency and Privacy Protection Act), and Tennessee (Information Protection Act), and additional states continue to enact similar laws. This Section is intended to satisfy those laws as well, to the extent they apply to us, but your rights under this Section do not depend on which state you live in or on whether your state has enacted a law of this kind.

    1. Categories of personal information we collect. In the last 12 months, we may have collected the following categories of personal information: identifiers (such as name, email address, telephone number, postal address, IP address, and other online identifiers); personal information described in Cal. Civ. Code § 1798.80 (such as contact information, financial information you provide, and signature); commercial information (such as programs purchased and transaction records); internet or other electronic network activity information (such as pages viewed and interactions with the Service); geolocation data (approximate location derived from IP address); audio and visual information (such as recordings of webinars, group sessions, and advisor calls where recording is disclosed); professional or education-related information a parent or guardian chooses to provide about a student; and inferences drawn from the above to create a profile about preferences. A more detailed summary appears in the table in Section 2.
    2. Sources of personal information. We collect personal information (i) directly from you or a member of your Household, (ii) automatically from your device or browser when you use the Service (for example, through cookies and similar technologies), and (iii) from our service providers, such as payment processors and scheduling and communications platforms.
    3. Purposes for collection and use. We collect and use personal information for the purposes described in this Privacy Policy, including to provide and maintain the Service, deliver the program you purchased, communicate with you, provide customer support, process transactions, monitor and improve the Service, and help keep the Service secure.
    4. Disclosure of personal information. We may disclose personal information to service providers and contractors for business purposes, including hosting, analytics, communications, scheduling, video, payment processing, and support vendors, and to our professional advisors and, where required, to governmental authorities.
    5. “Sale” and “sharing” (cross-context behavioral advertising). We do not sell personal information. We may “share” personal information with advertising or analytics partners through cookies or similar technologies for cross-context behavioral advertising, depending on your cookie settings and how the Service is configured. You have the right to opt out of such “sharing” at any time. You may opt out by (i) using a browser or device setting that sends a legally recognized opt-out preference signal (such as the Global Privacy Control), where available, and/or (ii) submitting a request by emailing us at office@yorkcp.com or using the methods described below. We will honor opt-out preference signals in a frictionless manner. We do not knowingly sell or share the personal information of consumers under sixteen (16) years of age.
    6. California “Shine the Light.” Separately from the rights described above, California Civil Code Section 1798.83 permits California residents to request information once each calendar year about any personal information we disclosed to third parties for those third parties’ own direct marketing purposes during the preceding calendar year. We do not disclose personal information to third parties for their own direct marketing purposes. You may still submit a request using the methods described below, and we will respond consistent with this Section.
    7. Sensitive personal information. We do not intentionally collect or use “sensitive personal information” (as defined by the CCPA) for the purpose of inferring characteristics about you. Where you voluntarily provide financial information in connection with a program, we use it only to perform the services you requested and for the purposes permitted by applicable law, and not for advertising.
    8. Retention. We retain personal information for as long as reasonably necessary for the purposes described in this Privacy Policy, unless a longer retention period is required or permitted by law. Specific retention periods are described in Section 15.
    9. Your privacy rights. Regardless of your state of residence, and subject to certain exceptions, you have the right to: (i) know or access the categories and specific pieces of personal information we collected about you; (ii) delete personal information we collected from you; (iii) correct inaccurate personal information; (iv) obtain a portable copy of your personal information; (v) opt out of the sale or sharing of personal information and of targeted advertising; (vi) opt out of profiling in furtherance of decisions producing legal or similarly significant effects; (vii) limit the use and disclosure of sensitive personal information, where applicable; (viii) appeal a denial of a request; and (ix) not be discriminated against for exercising these rights.
    10. How to exercise your rights. You (or your authorized agent) may submit a request by emailing us at office@yorkcp.com, by calling (858) 766-4471, or by submitting a request through yorkshirecollegeplanning.com. We will respond to verifiable consumer requests within forty-five (45) days of receipt or notify you if we require an extension (up to an additional forty-five (45) days). We will take reasonable steps to verify your request, which may include asking you to confirm information we already have on file. Authorized agents may be required to provide proof of authorization. You may designate an authorized agent by providing written authorization or a power of attorney. If we deny your request, you may appeal by replying to our response or contacting us at the address below; we will inform you in writing of the outcome of the appeal within the period required by applicable law.
    11. Notice of financial incentives. We do not offer financial incentives or price or service differences in exchange for the retention or sale or sharing of personal information.

  21. 21. Changes to This Privacy Policy.

    We may update our Privacy Policy from time to time. We will notify you of any material changes by posting the new Privacy Policy on this page. For material changes, we will let you know via email and/or a prominent notice on our Service, prior to the change becoming effective, and update the Effective Date at the top of this Privacy Policy. We encourage you to review this Privacy Policy periodically for any changes. Non-material changes are effective when posted on this page. Material changes will become effective as described above.
